1. Scope / Validity
The general terms and conditions of Lab Work s.r.o. (abbreviated as LW) apply to all customer transactions.
2. Offers / prices / order
Estimates are as of release date.
The guarantee for correctness arises only after the conclusion of the contract, but this does not apply to additional costs beyond the estimate. The offer prices apply when the order is placed immediately. Prices according to the current price list apply.
Material costs (surcharge for shrinkage and grinding loss), especially gold, are variable. Services are exempt from tax according to ยง 6 Zi.20 UStG. MD is liable for damages caused by purchased components only in the case of willful intent and gross negligence, unless the manufacturer has pointed this out.
3. Payment conditions / set-off / assignment
Invoices are without fees and deductions and are immediately payable net. In case of late payment, 12% interest will be charged. In case of delay, the customer must also pay the reminder and collection fees. Set-off against receivables from MD is excluded.
The customer is not entitled to withhold payments due to warranty and/or warranty claims. Claims against MD can only be assigned with express written consent. The delivered goods remain the property of MD until full payment.
4. Delivery / transport / insurance / deadlines
Pick-up and delivery in the SK area is free. The post office sends via EMS once DPD. The expedition takes place in the name, at the account and at the risk of the customer. Insurance is the customer's responsibility, MD ensures proper packaging and timely delivery. The delivery takes place within the valid production times, in the case of fast production, an express surcharge will be charged.
5. Acceptance / claim / guarantee
The customer is obliged to check the type, quality and completeness of the delivery immediately after taking it over and report any defects immediately. A perfect fit of the finished work on the model is guaranteed. For a period of 2 years, a guarantee is provided that the work is free of defects and that it corresponds to the state of the art. If the product is modified by the customer or a third party, the warranty expires. The validity of the latter also expires if the laboratory instructions for handling the product are not followed.
MD is not responsible for a delay in performance due to force majeure and authorizes MD to postpone performance for the duration of the obstacle. Compensation for defects or other consequential damages as well as net property damage is excluded. Any liability is limited to gross negligence or willful misconduct.
6. Norms and laws
All work is carried out in accordance with the basic requirements of the Medicines Act with the use of operational production documentation and instructions for the processing of used materials in versions specified by the customer according to the state of the art.
7. Place of performance / place of court / applicable law
The place of fulfillment is the seat of MD; Court location 2700 Wiener Neustadt. This also applies to disputes about the existence or non-existence of contracts. Austrian law applies.
8. Other
By sending the order, we accept these business, delivery and payment conditions. Any invalid or invalid provisions shall not affect the other provisions.
